Landmark Payout For Australian Boy Sucked Down Drain

articleA massive $9.6 million (Austalian Dollars) compensation deal will potentally be paid out to a boy who is claiming for personal injury after he suffered horrific injuries when he was sucked down a school drain.

Next week a judge will decide whether to accept the deal. If accepted and the boy is awarded the compensation it will set a record for the Australian state’s highest personal injury payout.

This deal follows a six-year legal battle between the Anglican Church and the family of the young man, now aged 18. The boy was sucked down a drain while boogie boarding on flooded grounds at the school in 2003.

The Anglican Church however argued that Myles caused or contributed to his own disability by “failing to take reasonable care for his own safety”. But lawyers for the young man, have maintained the accident was a result of the negligence of the school. The case will be settled next week one way or the other, but Myles will live with his injuries for the rest of his life.
