Gallbladder Removal Compensation

Claiming For Gallbladder Removal Compensation

If you have suffered from gallbladder medical negligence, you could claim gallbladder removal compensation. There are over 69,000 gallbladder operations performed in England and Wales every year. However, just like any other medical procedure, there is always the possibility that the procedure could not go as safe as one would like.

If there is a problem with the surgery, there could potentially be further injuries caused and there could be a need for follow-up surgery. Injuries caused by medical negligence during surgery can often be very painful and serious.

If you’ve suffered from an injury due to a gallbladder medical procedure, you could claim compensation. To find out how much compensation you can claim, speak to First Personal Injury today.

Gallbladder Removal Compensation Types

There are many different types of gallbladder problems that could occur due to a failed or negligent gallbladder removal surgery. The most common types of injuries/complications that occur from a negligent gallbladder removal surgery are:

Bile Leakage

In around roughly 1% of gallbladder surgeries there is a bile leakage. When the gallbladder is removed during surgery, the surgeon uses clips to seal the tubes that connect the main duct to the gallbladder. There can be bile leaks into the abdomen if the clips haven’t been properly fitted. This can be incredibly painful and serious if left undetected and it can cause long-term issues. Symptoms of bile leakages include:

  • Stomach pain.
  • Sickness.
  • A fever.
  • A swollen stomach.

Infections

A gallbladder removal surgery could cause internal wounds which are bad in themselves if they prove difficult to heal. Furthermore, these internal wounds could cause an internal infection. Symptoms of an infection include:

  • Redness on the skin of the area.
  • Pain in the area.
  • A leak from the wound, such as puss or internal bleeding.
  • Swelling in the area.

General Bowel Injuries

Injuries to the bowels, blood vessels or intestines could be caused during a gallbladder removal surgery. These injuries are often caused by the medical instruments that are used to removal the gallbladder. These injuries will usually be noticed and repaired during the initial surgery but they could cause further issues, such as pain, infection and the need for more surgery, if they are missed.

There is usually a three-year time limit for a medical negligence case. This date begins to count down from the date that the initial surgery occurred or from when you first noticed that you were suffering from a symptom indicating that you were suffering from a gallbladder-related injury. Therefore, you should contact a solicitor as soon as possible to assess your case.

Gallbladder Removal Compensation

The amount of gallbladder removal compensation that you are awarded is unique to the specific circumstances of each case. The amount of gallbladder removal compensation that you are awarded for your case will be determined by looking at two categories: general damages and special damages.

General Damages

General damages refers to the physical and emotional damage caused by your injuries or illness. In the simplest terms, it refers to compensation for pain and suffering. This type of compensation also covers any losses of amenity, aka a decrease in ability to function, that has arisen from the injuries sustained in an accident. Special Damages

Special damages compensation refers to compensation that covers the financial losses and expenses incurred as a result of an accident or medical negligence. Special damages could help to reclaim a loss of income if you have been unable to work due to your gallbladder removal compensation. Similarly, if you have had to pay to go to a medical appointment or if you had to pay to travel to a medical appointment, you could be able to claim these medical costs back.
