    Broken Tooth Claims

There are two common causes of tooth damage in a restaurant:

    • Injury caused by problems with the food – such as stones being left in olives
    • Tooth/mouth Injury caused by a slip, trip or fall

There are other accidents that could occur in a restaurant resulting in a broken tooth, if you have suffered a broken tooth as a result of any sort of accident in a restaurant environment, you may be able to claim compensation.

    ELIGIBILITY TO CLAIM

If your broken tooth was caused by negligence on the part of the restaurant owners or staff, your claim could be valid. If the injury was your fault, then you would not be able to claim. You may be able to claim for a broken tooth if:

    • You fell over a hit an object
    • Biting into a bone in your food that should have been taken out during preparation.
    • Biting into a substance that should not have been in your food such as glass.

Your teeth could be damaged in other ways than just breaking. You could have suffered a cracked or a chipped tooth. If it was caused by someone else’s negligence you could claim compensation.

    Amount of compensation

As all personal injury cases are unique, the amount of compensation awarded is different for every case. The amount awarded looks at general damages and special damages.Damages-specgen (2).png

You have just three years from the date of your accident in which to make a claim. Because of this, if you would like to make a claim, you must start the legal process as soon as possible. If you would like to claim on behalf of a child, this three-year timeframe begins on the date of their eighteenth birthday.
