Compensation For Sunbed Burns

If you have been burnt after using a sunbed, you could be entitled to make a compensation claim against the establishment where you underwent this treatment. If blame can be proven and attributed to the tanning salon, then your claim is likely viable.

Claiming for Sunbed Burns

Sadly, there are many risks associated with using sunbeds such as premature skin aging, damage to the eyes due to the UV light that is used in the process and the development of skin cancer as a result of exposure. These risks are inherent to using a sunbed but in certain cases, injuries or illnesses could be caused by the negligent behaviour of staff rather than being an inherent risk to using the product. For example, being burnt while using the sunbed is an injury that would usually be caused by improper use of the product and if this negligence occurred due to staff behaviour, this should not be tolerated.

f you believe that your burn was caused by the negligence of salon staff or the malfunction of a product, then you may be able to make a claim. Certain factors like faulty advice from staff, causing you to remain in the sunbed for too long, or the malfunctioning of the sunbed, could be grounds for a claim.

There are certain precautions that staff should always take to ensure the safety of their customers, such as:

  • Regularly testing the sunbed to ensure that it is safe to use
  • Checking the ID of customers to ensure that they are over the age of eighteen (the legal age required for someone to use a sunbed).
  • The customer should be asked to fill out a medical form by the staff so that they can be advised to not use the sunbed if they have certain medical conditions that could be alleviated by sunbed use.
  • Customers should be instructed by staff about how to properly use the sunbed to ensure that damage does not occur. Even if someone has gone to a tanning salon before, the sunbeds may be a different brand with different controls and conditions from salon to salon.
  • The customer should be made aware of any risks to their health which could occur due to their sunbed use. If the staff fail to warn customers of these risks, the salon could then be held liable for any injuries or illnesses that the client henceforth develops.

If you believe that your burn injury occurred due to the malfunction of the tanning bed or due to the negligence of salon staff, you could be able to make a claim.

Amount of Compensation

The amount of compensation you are likely to receive for a tanning bed injury is very dependent upon how the injury has impacted upon your life and the general severity of the injury. Compensation is awarded based upon the pain and suffering that your injury has caused, as well as any loss of amenity/function that has occurred due to the injuries. For example, if you have been unable to enjoy or complete certain tasks due to your burns then you may be able to claim compensation for this. If you have suffered minor scars to the face due to the burns, such as scars that are not visually very noticeable, then you may be awarded anywhere between £1,360 – £2,810. If you have suffered severe scars to the face, such as scars which caused disfigurement, then compensation may amount to £14,320 – £38,600 in compensation. If the burns were to a significant part of your body, then compensation could be upwards of £80,000.

Compensation will also take into account financial damages that have occurred, such as a loss of income due to being unable to return to work. Therefore, you should keep any receipts, such as receipts relating to treatment you have paid for, to see if these costs can be claimed back through compensation. The best way to determine how much compensation you are likely to be owed is to discuss your individual circumstances with us.
