    Employer Responsibility

The Health and Safety Executive (HSE) outlines that all businesses must have health and safety procedures in place in order to prevent an accident from occurring. This helps to decrease the likelihood of a member of staff or a customer being injured. These safety procedures will apply to all areas of the store, such as the backroom or the shop floor. Furthermore, areas of the store which have the potential to be more dangerous, such as warehouses, will be covered by further guidelines.

If you are a department store staff member you should have received training about any relevant procedures to your job role. If you have not, you may be able to make a claim. Similarly, if you have been injured whilst shopping in a store, you could be able to claim compensation.

Types of John Lewis Accident Claims

Certain accident types are more likely to occur in a department store context than others. For example, some common accident types include:

    • Slip, trip and fall accidents.
    • Manual handling accidents (mostly relevant to warehouse employees).
    • Falls from height accidents.
    • Food poisoning/food health and safety issues.
    • Cut on broken glass.
    • Lift or escalator accidents.
    • Accidents caused by poor stock stacking in the backroom or the warehouse.

If you have been injured while in a store, you should tell a manager or ask the closest staff member to alert a manager for you. The manager should then be able to help you fill in an accident report in the accident book, a document that all businesses are legally required to have. It is important that you check this report carefully in order to make sure that it records the circumstances of your accident accurately.

    John Lewis Accident Claim Compensation

Every personal injury claim is different, therefore meaning that every compensation amount will be unique and is not operated on a one size fits all basis. The amount of compensation that is awarded is determined by looking at two distinct factors – general damages and special damages.

Except for children, there is a three-year time limit on making a personal injury claim. This time limit begins from the date that the accident occurred. You should contact us as soon as possible to assess your case.
