Accidents that cause injuries to pedestrians can happen at any time of the day or night. They often happen when there is no control of the traffic and there is a higher incidence of these accidents in urban over rural areas.
Injuries to pedestrians can sometimes be caused by the pedestrian themselves, for example, not looking when crossing the road or crossing a dangerous road believing it to be safe.
However, many accidents happen as a result of driver error. By law, all drivers have a duty of care to road users including pedestrians and with that comes a responsibility to ensure safety as much as possible. If this duty has been breached and caused your injury then it could be possible to pursue compensation, providing it can be proven that the fault was theirs.
Hit and run accidents
You could be hit by a driver who stops but, in some circumstances, ‘hit and run’ cases do occur. In these situations, you may still be able to claim, even if the driver is uninsured. There is an organisation set up by the government called the Motor Insurers Bureau (MIB) to compensate victims for personal injury and damage to property in road traffic accidents (RTAs) where the driver is either uninsured or untraceable.
If it is a child under 18 that is injured, a parent or guardian can make a claim on their behalf. As with most personal injury cases you have a time limit of three years to make a claim, however, a child has until they are 21 to make a claim no matter what age they were injured.
